While Brett Kavanaugh — a man credibly accused of sexual assault by multiple women —

A very large number of people in the US disagree with that statement. At issue is the definition of “credibly.”

Congress was on the cusp of confirming a sexual predator

Opinion stated as fact.

Evidence of Kavanaugh’s sexual assaults may never rise to legal criminal standards

That’s kind of a given. No D.A. would prosecute, given the sparsity of evidence.

But that misses the point: the Supreme Court has a higher standard. Few Americans would entrust their teenage daughter to a man accused three times of sexual assault. Why should Congress entrust him with the rights of every American?

Serious question? Well, first off, Americans have entrusted their pre-teen daughters to him for decades, as a basketball coach. Which brings us to a piece of evidence that many seem to overlook; a lack of pattern behavior as an adult. Secondly, none of the three accusers were “credible” as the law defines the term (meaning, corroborating evidence; personal credibility of the accuser matters, but not as much as evidence does) And thirdly, there is nothing in his 300+ written opinions that leads on to the conclusion that he is anything other than a brilliant and consequential jurist.

If Kavanaugh and Clarence Thomas — another Justice accused of sexual harassment and confirmed nonetheless — can boldly issue rulings that impact our bodies and lives, then we sure as hell had the right to be at the Supreme Court, too.

You really need to have Bill Clinton in that sentence. If “women” were OK with a credibly (more so than Kavanaugh) accused rapist as the most powerful man in the world, then why wouldn’t they be OK with Kavanaugh?

This question cannot be ignored, when you look at the politics of the matter.

You are powerful. You matter. We hear you. We believe you. And we love you.

Yes. But take away the right lesson from all this, which really doesn’t have anything to do with Kavanaugh or the politics involved in all this.

When a sexual assault goes unreported, or is reported only after a period of time, the evidentiary trail grows cold. Time weakens the case of the accuser against the accused. I have used this event to drive home the message to my own daughter, which is, if you are EVER sexually assaulted, get a grip on your emotions, put aside any concerns you have about a “stigma” over your head, and GET TO THE AUTHORITIES PRONTO.

Because justice depends on investigation…. in real time.
