Well, I think you're straying a bit far from my original point, which could be summarized as saying "Trust the Constitution" and the Judiciary.

We probably agree that the verbal nonsense that spews from the mouth of politicians is substantial, and during election season, a lot of that nonsense falls into the category of "If the other guys win, OMG!!!!!!".

Point here is that if the "if the other guys win, OMG" statements are clearly unConstitutional, they are also unserious. And although I agree that "intentions matter", I don't (for example) get agitated about some of the policy proposals of the far left because I know they'd have to amend the Constitution to achieve it, and that ain't happenin'. :-)

So, I choose not to get worked up when I know the proposal is unserious. YMMV.
