This is why they have no business handling rape cases. Rape is a serious and life ending allegation and should not be handled by school staff and students, they are simply unqualified to conduct such investigations and trials.
I appreciate you picking up a nuance I should have caught.
Eve Moran is not wrong that there should be a fair system of on-campus tribunals to handle untoward noncriminal sexual advances. That could be a student which continues to badger another about going out on a date, to a student who doesn’t know it’s wrong to pinch a girl’s bum without an invitation. College brings together loads of people who are not socialized in the same way, and some who are poorly socialized, for that matter, and there are plenty of noncriminal things students can do to one another that still calls for the campus to intervene, for the sake of everyone’s safety.
THAT SAID, the moment an actual *criminal* matter is mentioned, rape being the most egregious example, the campus system needs to stand down immediately and let the police do their job, for exactly the reason you mention.
It bears mentioning that the Duke Lacrosse was moving quickly in favor of the alleged victim until one of the players that was accused was actually photographed by a camera at an ATM some distance away when he was allegedly doing the evil deed.
